New Extreme Sport Trading is a leading wellness and fitness solutions provider operating across the UAE, India, Qatar, Bahrain, and KSA. We deliver all types of gym setup services — commercial, residential, boutique studios, corporate fitness facilities, hotel & leisure gyms, and specialized training centers — including design, supply, installation, and optional maintenance & support.

2. Quotations, Orders & Payments

• All quotations are valid for a limited period (typically 30 days) unless stated otherwise in writing.
• Orders must be confirmed in writing via an official purchase order or signed agreement.
• Payment terms are specified in each proposal or invoice. Late payments may result in suspension of services, delivery delays, or applicable penalties.
• All prices are exclusive of VAT, taxes, customs duties, or other charges unless explicitly stated.

3. Delivery & Installation

• Delivery and installation timelines are estimates and may vary depending on product availability, logistics, customs clearance, and site readiness.
• The Client is responsible for ensuring the site is prepared to the agreed specifications (power, floor loading, clearances, permits) prior to installation.
• Delays or additional costs caused by site unpreparedness or client-caused rescheduling will be charged to the Client.

4. Warranty & Maintenance

• Equipment is covered by the manufacturer’s warranty; warranty duration and coverage depend on the specific product and brand.
• Warranty does not cover damage from misuse, negligence, lack of regular maintenance, incorrect installation by third parties, or unauthorized repairs.
• Preventive maintenance, extended warranties, and service contracts are available upon request as separate agreements.

5. Client Responsibilities

• Provide accurate and complete project information, including dimensions, access details, and any local compliance requirements.
• Ensure timely site access for deliveries, installation, and inspections.
• Obtain any permits, approvals, or local authority clearances required for installation and operation.
• Follow safety, operation, and maintenance guidelines provided with the equipment.

6. Limitation of Liability

To the fullest extent permitted by applicable law:

• New Extreme Sport Trading shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business interruption.
• Our total aggregate liability for any claim arising out of or in connection with these Terms shall not exceed the total amount paid by the Client for the specific order or project giving rise to the claim.

7. Intellectual Property

All designs, drawings, proposals, images, text, and other materials produced or supplied by New Extreme Sport Trading remain our intellectual property unless otherwise agreed in writing. You may not reproduce or distribute our materials without prior written consent.

8. Confidentiality

Both parties agree to keep confidential any non-public technical, commercial, or financial information disclosed during the course of business and not to disclose such information to third parties without prior written consent, except as required by law.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE, unless otherwise agreed in writing.

10. Force Majeure

We shall not be liable for any failure or delay in performing obligations caused by events beyond our reasonable control, including but not limited to natural disasters, acts of government, strikes, pandemics, supplier failures, transport disruptions, or other force majeure events. Performance times will be extended for the duration of such events.

11. Amendments

We reserve the right to amend these Terms at any time. Updated Terms will be posted on our official website or communicated directly to Clients. Continued use of our services after publication of updates constitutes acceptance of those changes.
